NEWS UPDATE
In July 2007 the Office for Fair Trading (OFT) launched a legal challenge against the ‘fairness’ of bank charges. This is against the seven main banks and one building society who equate to around 90% of the bank business.
OFT welcomes High Court ruling on unarranged overdraft charges

The High Court has today confirmed the OFT's view that personal current account unarranged overdraft charges can be assessed for fairness.
While this is a positive move forward it unfortunately does not mean that there is any date set for bank charges reclaim cases to continue.
There is a date set for late May when the timeline for moving the case forward and possible appeals will be discussed. After this date we would hope to be able to bring you more solid information.
How does this affect the customer?
The Financial Services Authority (FSA) put a waiver system in place allowing banks to put on hold all the cases that they currently have in their system. The Financial Ombudsman Service (FOS) have been instructed to put all cases they are reviewing through arbitration on hold. However, this waiver could be lifted at any time.
When the court case will be resolved is difficult to know with the possibility of appeals being used by the Banks to delay the decision. However we do believe that the decision will be in the favour of the consumer and it is important that your claim is dealt with promptly, otherwise the delay could be considerable. This is why we are still preparing the background case for each new client to try and ensure as swift a conclusion as possible
